1. Purpose

These Terms of Use govern how users (“you”) may use the Tipino platform, its website, and related services (collectively “the Service”).
They ensure fairness, integrity, and lawful participation within the Tipino community.

By accessing or using Tipino, you agree to comply with these Terms of Use.
Violation of these rules may result in suspension or permanent termination of your account.

2. Fair Use Principles

Tipino exists to support artists fairly based on authentic listening and engagement.
You agree to use Tipino in good faith and only for its intended purpose — supporting real musicians through transparent contribution.

You must not:

• Manipulate, automate, or simulate listening activity on Spotify or any other platform.
• Artificially influence payout calculations (e.g., looping tracks, fake plays, bots, or sharing accounts).
• Register multiple accounts to increase payouts or referral credits.
• Use Tipino for money laundering, fraudulent transfers, or illegal financial activity.
• Interfere with the normal operation of the platform or bypass security measures.

Any behaviour that undermines the fairness or credibility of the system is strictly prohibited.

3. User Content and Communication

Users may interact with Tipino by creating profiles, posting comments, or communicating with others (if such features are available).

You agree that:

• You are responsible for all content you post or share;
• You will not post illegal, defamatory, hateful, or obscene material;
• You will not impersonate others or misrepresent your identity;
• You will not use Tipino for spam, advertising, or solicitation unrelated to artist support.

Tipino reserves the right to remove or moderate content that violates these standards or harms the community.

4. Public Profiles and Visibility

Tipino allows users to control their profile visibility:

• You may choose to display your nickname publicly or remain anonymous.
• Artists may see the nickname of users who supported them, unless anonymity is selected.

Your profile and activity will never reveal personal identifiers such as your real name or email without consent.

5. Referrals and Community Sharing

You may invite other users to join Tipino.
Referrals must be made in an honest, non-spam manner.
You may not:

• Use automated referral systems;
• Post referral links in unrelated online spaces or paid traffic channels;
• Create fake accounts to simulate referrals.

Tipino may suspend or revoke referral benefits in case of abuse.

6. Spotify and Third-Party Integrations

Tipino relies on Spotify, Stripe, and other external APIs to function.
You acknowledge that:

• Data accuracy depends on the availability and completeness of Spotify’s data;
• Spotify may change its API or data policies at any time;
• Tipino cannot guarantee that Spotify integrations or payouts based on them will always work without interruption.

You agree to comply with Spotify’s own Terms of Use when connecting your account.

7. Platform Integrity and Security

To protect all users, Tipino employs automated systems to detect fraud or unusual behaviour.
By using the Service, you agree not to:

• Reverse-engineer or decompile any part of the platform;
• Access non-public systems or APIs without authorization;
• Upload malware, harmful code, or attempt denial-of-service attacks;
• Circumvent usage restrictions, technical limits, or account rules.

Security testing (e.g. penetration testing) requires written consent from Tipino.

8. Account Suspension and Termination

Tipino may suspend, restrict, or terminate accounts that:

• Breach these Terms of Use or the Terms of Service;
• Show suspicious or fraudulent activity;
• Abuse referral or payout mechanisms;
• Violate applicable laws or third-party terms.

Users will typically receive a warning unless immediate action is required to protect the platform or other users.

In case of termination for violation, no refund will be provided.

9. Reporting Abuse or Misconduct

We encourage users to maintain a respectful and fair environment.
If you notice abuse, fraud, or security issues, report them immediately to:

Tipino will investigate all credible reports confidentially.

10. Intellectual Property and Content Ownership

All rights in Tipino’s design, code, texts, graphics, and trademarks belong to Tipino or its licensors.
You may not copy, reproduce, or distribute any part of Tipino without written permission.

User-generated content remains your property, but by posting it on Tipino, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and adapt it solely to operate and promote the service.

11. Compliance with Law

You are responsible for ensuring that your use of Tipino complies with all applicable laws in your country, including those relating to:

• Data protection and consent;
• Financial transactions;
• Copyright and intellectual property.

Tipino may cooperate with authorities in cases of suspected illegal activity.

12. Service Modifications and Availability

Tipino may modify or discontinue any feature of the Service at any time for technical, operational, or legal reasons.
We will endeavour to give reasonable notice of major changes.

Temporary interruptions may occur for maintenance or third-party service outages.
Tipino is not liable for any loss resulting from such interruptions.

13. Disclaimer and Limitation of Liability

The Service is provided “as is” and “as available.”
Tipino makes no warranties about uninterrupted access, data completeness, or the accuracy of third-party data.

To the extent permitted by law, Tipino is not liable for:

• Indirect or consequential damages;
• Loss of data or revenue;
• Third-party actions beyond Tipino’s control (including Spotify, Stripe, or hosting providers).

Nothing limits Tipino’s liability for intentional misconduct or gross negligence.

14. Amendments

Tipino may update these Terms of Use as needed.
Changes will be announced via the website or email.
Continued use of the platform after updates constitutes acceptance of the revised terms.

15. Governing Law and Jurisdiction

These Terms of Use are governed by Swiss law.
Exclusive jurisdiction lies with the competent courts of Zurich, Switzerland, unless mandatory consumer laws specify otherwise.
